اصل 72 قانون اساسي ضمن معرفي مجلس شوراي اسلامي به عنوان مرجع رسمي تفسير قوانين عادي ميافزايد: «... مفاد اين اصل مانع از تفسيري كه دادرسان، در مقام تمييز حق از قوانين ميكنند، نيست.» بايد توجه داشت كه تفسيري كه قاضي پرونده و دادرس محكمه مينمايد، در خصوص موارد مشابه، اثري ندارد و قضات ديگر ملزم به رعايت آن نيستند. مقصود از «تفسير علمي» -كه گاه از آن به «تفسير حقوقي» تعبير ميشود- تفسيري است كه اساتيد دانشگاه، صاحبنظران و نويسندگان حقوقي از مواد قانون ارائه ميكنند.
